How a Tax Attorney can Help You

Fulfilling your tax responsibilities is not a simple task; it’s bound by intricate rules that you need to accurately follow in order to avoid paying penalties and possible incarceration due to tax fraud. With our Kentucky tax attorneys, you can ensure that you will minimize your tax bill as much as legally possible, and your tax returns and payments will be completed without errors.

First, however, we can help you determine if your income reaches the minimum requirements for tax filing. If not, we can help you file Form K-4 with your employer so that they will stop withholding state taxes from your wages. We will also assist you in letting your child file their tax return if they earned an income that meets or exceeds the threshold for filing.

Aside from helping with your tax returns and payments, we also offer expert legal services to handle the following tax concerns:

Prepare for and Contest Tax Audits

Being audited by the IRS is not inherently bad, although the process tends to be stressful and time-consuming. The IRS conducts tax audits to validate data in tax returns and ensure that the taxpayer is reporting accurate information and paying the right amount of tax. In the end, you may prove that your data entry is all accurate, and there will be no adjustments in your tax bill nor penalties that you have to pay.

As we identify the reason for your audit, Defense Tax Partners can help you prepare accordingly.

Included in what can trigger an IRS tax audit are the following:

1. Clerical errors (i.e., data entry errors)
2. Unreported income
3. Disproportionate or unusually high deductions (e.g., charitable donations, business expenses, home office deductions)
4. Non-existent dependants
5. Earned Income Tax Credit (EITC)
6. Self-employment with excessive reported losses

If we believe that the audit results have been less than fair, we can help you contest it and request an audit reconsideration. We could also negotiate on your behalf to reduce your penalties. More importantly, we will help you avoid any tax audit in the future.

Civil Penalty Relief

According to the Kentucky DOR, the following tax violations or failures have corresponding civil penalties:

  1. Late filing
  2. Late payment and failure to withhold or collect tax as required by law
  3. Underpayment of estimated income tax or limited liability entity tax, “LLET” (for tax years beginning on or after January 1, 2019)
  4. Late payment or underpayment of estimated income tax or LLET (for tax years beginning before January 1, 2019)
  5. Failure to furnish information or failure to file
  6. Failure to timely pay or protest tax by the DOR
  7. Failure to timely obtain a requested tax identification number, license, permit, or other documents of authority.
  8. Negligence
  9. Fraud
  10. Unhonored (bounced) check

Depending on your case, your penalty may be as low as $10 or as high as 50% of your assessed tax liability with no maximum amount. Fortunately, there are ways through which you can get penalty relief—something Defense Tax Partners can help you with!

The DOR may waive all or part of your civil penalties if you can demonstrate reasonable cause. We can help you do this by establishing that:

  1. The tax liability was incurred due to circumstances that are beyond your control,
  2. You acted reasonably and tried your best to accurately and timely fulfill your tax obligations,
  3. And/or the imposed penalties will cause you undue financial hardship if strictly enforced.

Similarly, the IRS also offers three types of penalty relief through the following:

  1. Reasonable Cause
  2. Administrative Waiver and First Time Penalty Abatement
  3. Statutory Exception

We will help you negotiate with either the IRS or DOR in order to lower your penalties as much as possible. We will also take charge of organizing and submitting the necessary documents to support your application, such as court records, hospital records, letters from your doctor, documentation of a natural disaster, etc.

Negotiations on Non-Filing of Taxes Violation

In Kentucky, late filing can incur a 2-20% penalty on your total tax due for every 30 days, or a fraction thereof, that your tax return is late. If you failed to file your return or furnish information, the penalty would be 5% of your estimated tax due for every 30 days, or a fraction thereof, that your return is not filed. The minimum penalty is $100 with a maximum of 50% penalty of your assessed tax liability.

If you work with Defense Tax Partners, our expert tax attorney will negotiate on your behalf in order to lower or waive your penalties. And if, unfortunately, your non-filing or erroneous return progresses into an investigation for tax evasion, we are also ready to proactively defend you and help keep your record clean and your finances stable.

Remember that in every tax violation, the best thing to do is to act immediately to mitigate the situation. Work with our tax attorney so you will know the most appropriate way of satisfying your tax liabilities and reaching a good tax settlement.
